Terms of Service

1. Acceptance of Terms
By using this website, submitting a quote or contact request, booking a service, purchasing a product, or authorizing work, you agree to these Terms of Service and to any applicable service terms, including our Service Policy and Privacy Policy. If you do not agree, please do not use the website or services.
2. Business Information
The service provider is Derrick’s Desktops LLC, operating publicly as Derrick’s Desktops (“we,” “us,” or “our”), a technology services business serving the Dallas-Fort Worth area, including DeSoto, Texas, with additional travel available by arrangement.
3. Services & Estimates
We offer PC repair, computer diagnostics, custom PC builds, hardware upgrades, virus/malware removal, software troubleshooting, Ethernet/network cabling, TV mounting, security camera and video doorbell installation, podcast/streaming setup, antenna/satellite dish removal, other onsite technology services, and related products/accessories.
Prices shown as “starting at,” estimated, or quoted are not final and may change based on the actual condition of the equipment, complexity, required materials or parts, travel, or the scope of work. Additional work outside an approved scope requires your authorization where reasonably possible before we proceed.
Diagnostic charges are separate from repair charges unless we specifically state otherwise. Quotes may include an expiration date, after which pricing and availability may change.
4. Customer Authorization
By approving a service request, you authorize Derrick’s Desktops to inspect, diagnose, repair, modify, install, configure, or otherwise perform the approved work on the equipment and/or property included in that request.
5. Customer-Owned Equipment & Property
You represent that you own the device or property involved, or that you have the authority to authorize the requested work on it.
6. Data Backup & Data Loss
Please back up important data before any repair, upgrade, or troubleshooting work. Computer service, hardware failure, malware, operating-system issues, drive failure, upgrades, and similar technical work can carry an inherent risk of data loss.
We use reasonable care to protect your data, but we cannot guarantee the preservation or recovery of data unless a specific data-recovery service has been agreed upon in advance.
7. Passwords & Device Access
To diagnose or configure equipment, you may need to provide passwords, PINs, or temporary access credentials. Any access you provide will be used only as reasonably necessary to perform the requested service. We recommend using temporary credentials where practical.
8. Custom PCs & Components
Parts availability and pricing may change. When a component is materially different, we will only substitute an equivalent replacement with your approval. Manufacturer warranties on components remain subject to the applicable manufacturer’s terms.
Custom-built PCs may require a deposit or payment before parts are ordered, and special-order or custom components may be subject to different cancellation or return limitations.
9. Installation Services
For TV mounting, Ethernet/network cabling, security cameras, video doorbells, antenna/dish removal, and similar property installations, you are responsible for disclosing known conditions that could affect the work, including concealed electrical or plumbing lines, unusual wall construction, asbestos or other hazardous materials, HOA or property restrictions, landlord restrictions, and structural issues.
We may pause or stop work when conditions make the requested installation unsafe or materially different from the quoted scope, and revised pricing or scope may apply.
10. Travel & Service Area
Some onsite services may include travel or mileage charges depending on your location. Applicable travel charges are calculated according to our current service rules and are shown or communicated before the service is confirmed.
11. Payments
Payment is due according to the invoice, checkout, or service agreement. Applicable taxes may be added where required. Payment processing may be handled by third-party payment providers, and you must provide valid, authorized payment. A chargeback does not automatically eliminate a valid payment obligation for services performed or products provided.
12. Financing / Buy Now, Pay Later
If financing or “buy now, pay later” options (such as those offered by third parties like Klarna, Afterpay, Affirm, or PayPal) are available at checkout, those services are provided by third parties and are subject to their own eligibility requirements and terms. Derrick’s Desktops does not determine approval for those services.
13. Cancellations, Returns & Refunds
Cancellations, returns, and refunds are governed by our Service Policy, which is the controlling policy for deposits, cancellations, no-shows, and related matters. Please review it for the full details. If any provision of these Terms appears to conflict with the Service Policy, the Service Policy controls for those topics.
14. Scheduling & Access
You must provide reasonable access to the equipment or property at the scheduled time. Delays caused by inaccessible equipment or property, undisclosed conditions, or customer-requested scope changes may affect timing and pricing.
15. Third-Party Products & Services
We may recommend, install, or link to third-party hardware, software, or services. Those companies maintain their own terms, warranties, and privacy practices, and your use of them is subject to those terms.
16. Website Use
You agree not to use the website for any unlawful purpose, and specifically not to:
- engage in fraud or misrepresentation;
- attempt to interfere with, disrupt, or damage the website;
- gain unauthorized access to systems, accounts, or data;
- upload malicious files or code; or
- abuse the quote, upload, or contact systems.
17. Intellectual Property
The Derrick’s Desktops name, branding, original website content, graphics, and other proprietary material may not be copied or commercially reused without permission, except for content that belongs to third parties and remains subject to their rights.
18. Disclaimer of Warranties
Except where a specific warranty is provided in writing, services and products are provided on an “as is” and “as available” basis to the extent permitted by law. We do not attempt to disclaim any warranties or protections that cannot legally be disclaimed under Texas or federal law.
19. Limitation of Liability
To the extent permitted by law, Derrick’s Desktops is not liable for indirect, incidental, special, or consequential damages, and our total liability for a claim will not exceed the amount you paid for the specific service or product giving rise to the claim. Nothing in these Terms limits any rights that cannot legally be waived.
20. Indemnification
You agree to reasonably indemnify and hold Derrick’s Desktops harmless from claims arising out of your unlawful use of the website or services, your false representation of ownership or authority, or your misuse of the services.
21. Governing Law
These Terms are governed by the laws of the State of Texas, without limiting any mandatory consumer protections that apply to you.
22. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date above identifies the most recent revision, and continued use of the website or services after an update constitutes acceptance of the revised Terms.
